9 Protesters Plead Guilty to Unlawful Assembly

Nine protesters arrested by police officers on Wednesday pleaded guilty to unlawful assembly before a Nairobi court.

The protesters were accused of participating in Wednesday’s demonstrations while running and obstructing other road users. Stephen Baraza, and Kennedy Kinywa among others appeared before Milimani chief magistrate Lucas Onyina.

They admitted to running, shouting, destroying property, and obstructing other road users. The prosecution claimed that their actions caused fear in other road users and were breaching the peace in their area.

The prosecution said that on Wednesday at 11 am, people were taking part in the unlawful assembly within Embakasi. He went ahead to state that the people were throwing stones at the public and motorists in the area.

The prosecution mentioned that Stephen Baraza was caught recording and filming the police officers on his phone. The phone was confiscated by the officers while he was arrested and taken to the station.

Magistrate Onyina is set to sentence the nine accused people on Friday.

Other protesters arrested and awaiting court presence

At that same court, three MCAs from Nairobi are set to appear as well as three employees of Nairobi County. They are among the people that were caught and arrested by the police officers on Wednesday during the demonstrations held.

Among those arrested is Babu Owino who was detained in Kirinyaga but was transferred later today. He is said to be taken to the Nairobi Area police station. His lawyer, Okatch said that he does not know whether he will be arraigned or not.

In a statement released by Martha Karua, she mentioned that the arrests and abductions had no lawful justifications. She further stated that the arrest would not stop their struggle or their third wave of protests.

The government on the other hand hint at the possibility for dialogue. In a speech issued by the president in Kericho yesterday( Wednesday), he hinted at the government being open to dialogue on the condition that the opposition would not ask for a power-sharing agreement.
