The Constitutional Implementation Oversight Committee chaired by Githunguri Member of Parliament Gathoni Wamuchomba, held a meeting with the Interior Cabinet Secretary Kithure Kindiki.
The meeting served as a follow up after the Committee’s earlier engagement with the National Police Service Commission (NPSC), and the Commission pleaded with the Committee to protect its mandate.
The Committee wanted to be informed on the recruitment and appointment of persons to hold or act in offices, including confirmations, determination of promotions and transfers within the National Police Service and the compliance, with the Constitution and the National Police Service Commission Act.
Speaking during the meeting, Prof. Kindiki said that subject to Article 246(1)(a) of the Constitution, the National Police Service Commission is responsible for recruitment for all positions within the Service including vacancies for specific specialist positions and civilian.

”According to section (10) 2 of the NPSC Act, the Commission may delegate to the Inspector General the recruitment, appointment and promotion of police officers below the rank of Superintendent,” he added.
“Chair, Article 245 (2) provides that the Inspector General shall exercise independent command and control over the Service and perform any other functions prescribed by national legislation,” said Prof. Kindiki.
Members of the Committee inquired to know why the Inspector General is fearing to appear before the Committee.
Prof. Kindiki pleaded with the Committee to understand the Inspector General, noting that the IG wrote a letter to request the CS to appear before the Committee on his behalf.
However, Honorable Gathoni Wamuchomba disagreed with him saying, “The Inspector General is part of the Commission. It is the Committee’s mandate to oversee the Commission. Unless you want us to amend the Constitution and remove him from the Commission.”
Additionally, the Member of Parliament took to her Facebook page writing, ”Critical issues first ; Security is a Right and Must be provided in line with the constitution of Kenya. The Cabinet Secretary Prof Kithure Kindiki has assured the committee that going forward, the Commission is allowed to execute it’s mandate without interference.”
