Petitioner Calls for Malala, Ndii and Others out of the Cabinet

A city lawyer has gone to court to remove Malala, Ndii and other ‘strangers’ from the cabinet. The petition comes after the president made the decision for them to be involved in cabinet meetings.

UDA secretary General (Cleophas Malala), Chief economic advisor of the president (David Ndii), National security advisor of the president (Monica Juma), and The president’s advisor on women’s rights (Harriette Chiggai) were allowed by the president into the cabinet.

Charles Mugane, the city lawyer, filed a petition to the Milimani High Court following this decision made by the president. He urges the court to bar the officials from attending cabinet meetings in totality. According to the lawyer, these four took the Oath of Secrecy illegally when they went ahead to attend the cabinet meeting last week.

He further claims the president allows the four to sit in the cabinet, a decision he made without involving the national assembly. This is the second case that has been filed regarding members who are not in the cabinet attending cabinet meetings.

The last petition was filed during the Jubilee Regime. Justice Mrima bared Badi from sitting in the cabinet despite being approved by former president Uhuru Kenyatta. The ruling was based on grounds of his appointment not being approved by the national assembly. In addition to this, Mrima did not find any valid reason for Badi to sit in for the cabinet meetings.

Mr Mugane uses the same grounds for the last court rulings to petition the removal of ‘strangers’ from sitting in cabinet meetings.

“The inclusion of the four was done without the involvement of parliament. The same insulates the ‘strangers’ from oversight as provided by Article 95 (5) of the constitution, the same being null and void,” he said.
