DCI Arrests Suspect Over Nine Alleged Fake Injury Claims

Nairobi detectives have arrested a man accused of helping orchestrate nine fraudulent injury compensation claims linked to a 2023 road accident.

Edwin Odhuambo Oduor was arrested by detectives from the Insurance Fraud Investigations Unit in the Omega area of Kasarani, according to the Directorate of Criminal Investigations.

The case centres on an accident involving two vehicles along Kangundo Road on September 8, 2023.

Investigators allege that Oduor coordinated several people who later presented injury claims to an insurance company. The claims stated that the individuals had been injured in the crash.

The allegations have not been tested in court, and Oduor remains presumed innocent unless proven guilty.

Insurance company raised questions

The investigation began after Jubilee Insurance raised concerns about the authenticity of the claims and referred the matter to the Insurance Fraud Investigations Unit.

Detectives said their inquiries uncovered supporting documents that were allegedly obtained fraudulently from Mama Lucy Hospital and Kayole Police Station.

The findings prompted investigators to forward the case file to the Office of the Director of Public Prosecutions for review.

The ODPP says prosecutors must assess whether evidence is sufficient before criminal proceedings are brought. Its charging guidelines require both an evidential and public-interest assessment.

Charges recommended

Following its review, the ODPP recommended that Oduor face charges of conspiracy and insurance fraud, according to the DCI account.

The investigation highlights the challenges insurers face when assessing compensation claims following road accidents. False claims can increase costs for insurers and complicate legitimate claims by genuine accident victims.

Detectives have warned members of the public against submitting falsified documents or organising false claims for financial gain.

The next stage will be for the suspect to face the criminal justice process, where the allegations will be tested and the prosecution will be required to prove its case. The ODPP notes that accused persons retain their legal rights throughout the process.
