The court ruled that the prosecution failed to provide sufficient evidence to prove its case against the preacher, who was deported from the UK in August 2017 to face these charges.

Deya had been accused of stealing five children, all under the age of 14, between 2002 and 2004 in the Mountain View Estate of Nairobi.

His wife was also implicated in the case but, like Deya, was also set free due to the prosecution’s inability to substantiate the allegations.

Addressing the media following his release, a visibly relieved Deya expressed his forgiveness towards his persecutors and announced his intention to return to the UK to continue his ministry.

“The case tarnished my name, but I’m happy to be going back to the ministry. I’m pleased that I have been acquitted,” Deya stated.

During the trial, Deya’s lawyer, John Swaka, highlighted numerous inconclusive and inconsistent discrepancies in the prosecution’s evidence. Swaka argued that these shortcomings could not lead to a safe and secure conviction.

The court agreed with the defense’s assertions, ruling that the burden of proof against Deya was not met, as none of the evidence placed him at the locations where the children were recovered.

“The prosecution failed to establish circumstantial evidence. Therefore, under section 250 of the CPC, I acquit the accused,” declared Milimani senior principal magistrate Robison Ondieki.

The case against Bishop Gilbert Juma Deya, known for his controversial background, has garnered significant attention over the years. The acquittal will undoubtedly spark further debate and raise questions about the handling of child theft cases in the country.

While Deya’s release marks the end of a prolonged legal battle for him and his wife, the consequences of the trial have left an indelible mark on their lives. Their reputation has been significantly affected, and the ordeal has taken a toll on their personal and professional lives.

As the controversial preacher prepares to resume his ministry in the UK, it remains to be seen how this acquittal will impact his standing within his congregation and the broader public.
