Supreme Court upholds William Ruto's win

During delivery of the verdict on the petitioned win of President-elect William Ruto, Chief Justice Martha Koome of the Supreme Court noted that the deployed technology was in accordance with the law.

The verdict stated by Chief Justice Martha Koome has authenticated the president-elect is William Ruto having won against petitions that ruled out his win.

“We are not persuaded by the allegation that the technology deployed by the IEBC failed the standard of Section 86 (A) of the constitution on integrity, verifiability, and transparency for the following reasons. Whereas it is true that the KIEMS kits failed in 235 polling stations 86,889 voters were granted the right to vote manually and the requisite Form 32A was duly filed. This happened successfully in Kibwezi constituency and part of Kakamega County,” read part of the ruling.

Another main issue was with the Hacking allegations earlier stated by the Azimio petitioners after the sight of Jose Camargo’s name on the form and the hacking of the IEBC portal as individuals went through without verification.

To which the judgment read that the court had inconsequentially thrown out the evidence tabled by John Githongo, stating that it may have contained forgeries and did not meet the evidential threshold.

“In regards to the form 34A which was sensationally presented by Julie Soweto to show that Camargo accessed the RTS and interfered with the result contained therein, this also turned out to me no more than hot air and we were taken on a wild goose chase which yielded nothing of converting value,” the judge said.

However, the court weighed in on the IEBC’s lawyer’s denial of claims by the main petitioner, Raila Odinga that its system had been infiltrated to allow for original forms 34A to be deleted and replaced with doctored forms which were uploaded to the portal.

According to lawyer Mahat Somane, if you look at the form attached to the portal and even the one the petitioner submitted, there was no agent at the polling station. Hence the information had to have been tampered with failing to meet the threshold as evidence.

“Those averments contain no more than hearsay, no admissible evidence was presented to prove the allegations that form 34 A were fraudulently altered by a group in Karen,” she added.

Therefore, the court has declared that no discrepancies in form 34As were obtained worthy of a nullification of the elections that the IEBC Chairman Wafula Chebukati announced President-elect William Ruto as the winner.

Supreme Court has officially declared Ruto as the winner of the presidential elections following a lack of evidence to petition the elections conduction and free as well as fairness.
