EACC: Oparanya Unfit to Be CS

The Ethics and Anti-Corruption Commission (EACC) has disapproved former Kakamega Governor Wycliffe Oparanya’s nomination as Cooperatives and MSMEs Cabinet Secretary due to an ongoing graft case.

In a letter dated July 29, the EACC addressed the Clerk of the National Assembly, raising concerns about Oparanya’s integrity and casting a shadow over his nomination.

The EACC’s investigation revealed allegations of corruption during Oparanya’s tenure as Governor, leading to the filing of preservation orders against his assets. The commission suspects that Oparanya has proceeds from corruption arising from a conflict of interest, with Ksh28.9 million of his assets frozen. This matter remains pending in court.

The letter from the EACC was a response to a request from the Clerk of the National Assembly for a background check on the nominees’ integrity. While all other nominees have been cleared, Oparanya faces significant hurdles due to the EACC’s findings.

According to the Public Appointments Act, Parliament must consider the selection procedure, constitutional and statutory requirements, and the nominee’s suitability based on their abilities, experience, and qualities. The Constitution mandates the EACC to implement Chapter Six on Leadership and Integrity, guiding the nominee’s suitability regarding integrity issues.

The EACC’s information will now be available to the vetting committee as the vetting process for Cabinet Secretaries begins on Thursday. Oparanya’s appearance before the committee is scheduled for Sunday. Kenyans have urged the Committee on Appointments to be strict and unforgiving towards leaders with integrity issues.

Oparanya’s nomination has been significantly impacted by his alleged past misconduct, with the EACC’s findings likely to influence the committee’s decision. The situation underscores the importance of maintaining integrity and transparency in public office appointments.
