Julius Malema, leader of the Economic Freedom Fighters (EFF), has been granted leave to appeal his five-year prison sentence following his conviction in a firearm discharge case.
The ruling marks a significant development in the high-profile matter that has drawn national attention and political debate across South Africa.
While the court rejected Malema’s attempt to appeal his conviction, it ruled that he may proceed to challenge the severity of his sentence at the High Court.
Malema had been sentenced for unlawfully possessing and discharging a firearm during a 2018 rally held in Mdantsane, an incident that formed the basis of the charges under the Firearms Control Act.
Malema Released Pending Appeal Outcome
In a further relief to the EFF leader, the court ordered his release on warning, meaning he will remain free while awaiting the outcome of his appeal.
This decision allows Malema to continue his political activities as the legal process unfolds, avoiding immediate imprisonment despite the five-year sentence previously handed down.
The development introduces a new phase in the case, shifting focus to the High Court where arguments will center on whether the sentence imposed was appropriate.
