Kiambu Senior Principal Magistrate Wilson Rading has ruled that the case against Nick Mwendwa is ‘defective, unlawful, unconstitutional and abuse of the court process/criminal justice system.’
After being adjourned five times, FKF President Nick Mwendwa is feeling the relief of getting back on the top seat in Kenyan football after Magistrate Wilson Rading, now transferred to Naivasha ruled, “This honorable court hereby issues orders to the effect that the charge sheet dated July 7, 2022, and or any other charge sheet prepared and registered in this court by the DPP and or his prosecutor(s) against the accused person after July 6, 2022, be and is hereby struck out for being defective, unlawful, unconstitutional and for being an abuse of the court process/criminal justice system.”
Magistrate Rading advised the FKF leadership to go ahead and start developing football by encouraging young Kenyans with the talent to compete with foreign stars like Kylian Mbappe and Lionel Messi, “Football which is a beautiful game suffers when there is push and pull of this kind. What is the fate of the thousands of youth who wake up in the morning to go to the fields to play football? Will they rise to the level of Lionel Messi or Kylian Mbappe and is theirs a lost cause?”
On July 6, 2022, Nick Mwendwa’s 38 million shillings graft case was dismissed by Magistrate Nyuttu but the DPP filed a fresh case against the Kiambu Court.
Nick Mwendwa had been accused of stealing Sh2,500,000 on May 15, 2021, according to the first accusation.
The second accusation claimed that Mwendwa stole Sh5 million on March 4, 2021.
The third count of the indictment accused Mwendwa of taking Sh1 million on May 6, 2021, while the final count charged him with collaborating with those who are not in court to defraud FKF of Sh29,502,709.
On November 11, 2021, Mwendwa was initially detained, and three days later, he was brought before the court.
On November 31, 2021, he resigned from his position as FKF president and turned the federation’s leadership over to his deputy.
