Kiambu senior principal magistrate Wilson Rading said Nick Mwendwa’s ruling was not ready. The case has also hit a stalemate after it was revealed that Rading, who is in charge of the case, has been transferred to Naivasha Law Courts. Onunga and Mwendwa’s attorneys had gone before Rading on Wednesday to hear the verdict. Rading said, “The ruling of this case is not ready. I will deliver it on March 29,2023…The ruling is not ready. The file is yet to be returned from the high court to enable me pen my decision.”

The magistrate ordered the parties to return on March 8 so that he can decide whether or not Mwendwa has a valid case. Nevertheless, the case was not even over when the parties were told to return.

Defense attorneys Mutua, Njenga, and Omwebu sought the judge to drop the new charges brought against Nick Mwendwa, claiming that Chief Magistrate Eunice Nyuttu of the Milimani Anti-Corruption Court had cleared him.

On July 6, 2022, Nick Mwendwa’s 38 million shillings graft case was dismissed by Magistrate Nyuttu but the DPP filed a fresh case against the Kiambu Court.

Mwendwa is accused of stealing Sh2,500,000 on May 15, 2021, according to the first accusation.

The second accusation claims that Mwendwa stole Sh5 million on March 4, 2021.

The third count of the indictment accuses the defendants of taking Sh1 million on May 6, 2021, while the final count charges them with collaborating with those who are not in court to defraud FKF of Sh29,502,709.
The decision to charge Mwendwa, according to Onunga, was “influenced by the sufficiency of evidence on record, public interest and not any other consideration.”
