Rally Driver Maxine Wahome faced the court on Tuesday and highlighted that she was in an abusive, violent and dehumanising love affair. As reported by Nation, Maxine told the court that she was introduced to the sport by Asad, who was also a mechanic and he fixed her rally cars when she got famous. Previously Maxine was a nursery schol teacher in the neighborhood.

Ms Wahome’s lawyer Philip Murgor pleaded for the accused to be give a lenient bail on the grounds that Asad and his brother pocketed all her rally sponsorship funds and their family had also confiscated her car and were demanding Ksh. 2.9 millon to release it.

“Ms Wahome is a young lady aged 25 years and is dependent on her parents. Asad was a mechanic who helped her fix her rally cars and when she got famous, all the sponsorship money ended up in the hands of Asad and his brother Adil (Khan),” claimed Mr Murgor.

“As she stands here, she does not have anything in her pocket and very little in her bank account.”

However, Judge Lilian Mutende dismissed the claims noting the court would not record the lawyer’s claims on confiscation of the car and the money demands.

Mr. Murgor claimed that Asad died after hurting himself during a fight at their home on the evening of December 12, 2022, and that Ms. Wahome was a victim of gender-based violence. He added that Asad was intoxicated during the incident, “Evidence shows no guilt on the part of the accused. On their evidence, one of the documents provided to court is a report from Nairobi Hospital showing that Khan was so impaired to be in control and one can die if he had underlying health condition. He was drunk.”

The senior attorney further claimed that Chemtai Chepkorir, a neighbor and one of the targeted prosecution witnesses, claimed in her testimony that she overheard “a woman crying as Asad was yelling for Ms Wahome to leave the house immediately” on the fatal day.

Lawyer Murgor said, “She (the witness) confirmed seeing blood. Another witness, Hassan, confirmed hearing the shouts. Samuel Kimani another neighbour of 10 years said Asad Khan was violent to all his girlfriends. There are no compelling reasons to deny the accused bail.”

In opposition to her request for bail, the prosecutor and Asad’s family asked the court to hold her in custody until the trial.

The court determined that Ms. Wahome will remain in custody until it obtains a pre-bail report in order for it to schedule a hearing to decide on her bail request. On March 27, the case will be mentioned virtually.
