The Mwai Kibaki property Row and His Children’s Reactions

Former President Mwai Kibaki’s estate which he left behind to his four children, has been rocked by allegations that he sired children out of wedlock who want a share of the inheritance.

The allegations came about during the late former head of state’s burial, on April 30, in Nyeri High Court. The case was moved to Milimani Law Courts according to Kibaki’s children’s appeal.

One Jacob Ocholla Mwai and a lady by the name Ms JNL moved to court to petition to be recognized and included in the inheritance of the late Kibaki. Ocholla wants the tests to prove he is the firstborn to Kenya’s third president.

The two want the court to direct them together with Kibaki’s four children, Judy, James Mark, David Kagai and Andrew, to be subjected to a DNA test to determine if they are siblings. They also requested alternatively that the court grants them permission to exhume his body.

According to Ocholla’s attorney, this move is necessary since there are no known DNA samples of Kibaki stored in a data bank or any other facility.

However, Kibaki’s children led by Judy have come out to strongly oppose the request. Kibaki’s children claim the request is a violation of their privacy and disregard Kibaki’s status as a former head of state. On the exhumation of the body, she said his burial was a state function and it played a great role in the nation.

Therefore they have requested the court to throw out the duo’s requests in this case.

Ocholla through his lawyer went ahead to give details on his connection with the former head of state. He claims his adoptive father Hillary Ocholla and Kibaki attended Makerere University during the same period and that is when his mother met and sired a child with Kibaki.

Ocholla since the case started claims that efforts to contact the former’s children have failed which is why he is pushing for the DNA tests.

However as it is known by Kibaki’s family, he left his wealth equally shared among his bloodline. In his lifetime he did not acknowledge or hint about any family other than his first family.
