The Independent Electoral and Boundaries Commission (IEBC) has warned Kenyans against taking photos or recording videos inside polling booths during voting, saying the act is a criminal offence under Kenyan election laws.
In a public notice shared ahead of the upcoming by-elections, the commission emphasized that the secrecy and sanctity of the ballot must be protected at all times.
The electoral body cautioned that any voter found capturing images or videos of marked ballot papers inside polling stations risks arrest, prosecution, hefty fines, or imprisonment.
Recording Inside Polling Booths Is Illegal
According to the commission, photography and video recording are strictly prohibited inside polling booths.
The IEBC cited Section 7(3)(e) of the Election Offences Act No. 37 of 2016, which states that any person attending election proceedings who, without lawful excuse, captures an image of a marked ballot paper for purposes of financial gain or to demonstrate political allegiance commits an offence.
The law seeks to protect voter privacy and prevent voter intimidation, bribery, coercion, and manipulation during elections.
Penalties Include Jail Time and Heavy Fines
The electoral body warned that anyone found violating the law could face severe penalties.
Under the Election Offences Act, offenders risk a fine of up to KSh 1 million, imprisonment for a term not exceeding three years, or both.
The commission urged voters to comply with electoral regulations and avoid activities that could compromise the integrity of the voting process.
