Former Chief Justice Willy Mutunga on Friday, July 7, was seen shopping for basic items together with Human rights activist Boniface Mwangi, for protestors that were arrested during the Sabasaba demonstrations held by the Azimio coalition.
In the video, Mutunga talked about how he realized that he has not visited anyone in jail for a long time. He also added that back then people used to visit those in jail while carrying fruits and some basic stuffs like tissues.
Speaking in the video, Human rights activists Boniface Mwangi is heard saying that both him and the retired Chief Justice will visit protestors who are being detained at the Central Police Station in Nairobi.
According to Article 37 of the constitution, every person has the right, peaceably and unarmed, to assemble, to demonstrate, to picket, and to present petitions to public authorities.

“It is very clear that the police are out there to protect the protestors not to arrest them. So we have a police force that is not decolonized. I think the Attorney General and the Inspector General should be told what exactly two articles 37 and 38. I think we should start suing these guys for false arrest and malicious prosecution,” said the former Chief Justice.
Speaking in Nairobi, Mutunga opinioned that the Interior Cabinet Secretary Kithure Kindiki and Attorney General Justin Muturi, should be the ones advising and guiding the Inspector General of Police Japhet Koome and his troops on how to handle protestors. He asserted that the two lawyers have immersed themselves into their political careers and forgotten about their responsibility which is to tell the Inspector General what the constitution to says.
Additionally, Mutunga added that the government will look good if it allows and protects people to demonstrate when they are unarmed.
