The Court of Appeal of Kenya has ordered the unfreezing of Sh537 million belonging to former Nairobi Governor Mike Sonko, dealing a significant setback to the Assets Recovery Agency (ARA).
In its ruling, the appellate court found that the High Court had erred in granting a stay order that allowed the continued freezing of the funds.
The money had previously been seized by ARA on grounds that it constituted proceeds of crime.
Background of the Sh537 Million Dispute
The case dates back several years, with the Assets Recovery Agency pursuing legal action to retain control of the funds, alleging they were illegally acquired.
The prolonged legal battle saw the assets remain frozen for six years as the matter moved through the courts.
However, the Court of Appeal’s decision effectively overturns the earlier High Court position, paving the way for Sonko to regain access to the contested funds.
Sonko Celebrates “Justice After Six Years”
Following the ruling, Mike Sonko expressed relief and gratitude, describing the judgment as long-overdue justice after years of legal struggle.

“I’m also grateful to the courts for judging based on facts and evidence, not personal hate. Special thanks to my lawyer, Harrison Kinyanjui, for never giving up on me… God is watching, and justice will always prevail.”
The decision marks a major legal victory for Sonko and a major setback for the Assets Recovery Agency.
