The United Democratic Alliance (UDA) has pushed back against a High Court ruling touching on the purported merger between the ruling party and the former Amani National Congress (ANC), insisting that the court decision is based on a non-existent arrangement.
In a press statement dated January 23, 2026, UDA said the ruling delivered on January 22 had been overtaken by events and mischaracterised the legal status of the former ANC party.
ANC Was Voluntarily Dissolved, UDA Says
UDA clarified that there was never a merger between ANC and UDA, either in fact or in law.
Instead, the party said ANC was voluntarily dissolved by its own members during a Special National Delegates Congress held on February 7, 2025.
UDA further claims, the dissolution was formally gazetted on March 14, 2025, through Gazette Notice No. 3449 by the then Registrar of Political Parties, Ann Nderitu.
“Clearly, what was done was a voluntary dissolution by the ANC party by its members. Therefore, the matter of ANC having ‘merged’ with UDA is not factual,” the statement read.
UDA argued that declaring the alleged merger unlawful amounts to what it termed a legal fiction, noting that a decision that never existed cannot be nullified.
“You cannot nullify a decision that never was in the first place,” the party stated.
Following the dissolution, UDA said all ANC assets were lawfully transferred to the ruling party, while former ANC members were fully integrated into UDA through established legal and operational procedures.
The party stressed that there are no parallel structures, competing claims, or ambiguities arising from the dissolution and integration process.
UDA Shifts Focus to Unity and 2027 Re-election
Signed by Lamu Governor Issa Timamy, who is also UDA’s Second Deputy Party Leader, the statement reaffirmed the party’s focus on unity, mobilization, and governance.
UDA said its priority remains consolidating party integrity and working towards the re-election of President William Samoei Ruto, while delivering on the Bottom-Up Economic Transformation Agenda (BETA).
“Our focus remains on delivering real, measurable development outcomes for the people of Kenya,” the statement concluded.
