Nyamira Governor Amos Nyaribo has survived an impeachment scare after Senators voted to uphold a preliminary objection, stopping the case from proceeding to a full hearing.

Nyamira Governor Amos Nyaribo has survived an impeachment attempt after the Senate voted overwhelmingly to uphold a preliminary objection raised by his legal team.

The landmark decision effectively brought the impeachment proceedings to an abrupt halt, saving the embattled Governor.

During Wednesday morning’s session on the proposed removal of Governor Nyaribo from office, Senators voted 38–4 in favour of the Motion that sustained the objection.

Nyaribo’s Legal Team Challenges Validity of Impeachment Motion

At the beginning of the sitting, Governor Nyaribo’s lawyers mounted a firm challenge by raising two preliminary objections aimed at invalidating the impeachment process.

The first objection questioned the legality and competence of the impeachment Motion dated 11 November 2025, arguing that it failed to meet the constitutional and statutory requirements.

The defence argued that the Motion did not satisfy the mandatory thresholds under Article 181 of the Constitution and Section 33 of the County Governments Act, rendering the resolution to impeach the Governor “invalid and incompetent.”

Proxy Voting: Legal or Fraudulent?

The second objection, led by counsel Elias Mutuma, centred on alleged irregularities in the County Assembly vote.

The Governor’s team dismissed the claim of proxy voting as “alien to the law, illegal and void.”

They argued that only 19 MCAs were physically present in the chamber during the vote, yet the Assembly recorded 23 votes in favour of the impeachment Motion, a discrepancy they termed “numerically impossible, improper and fraudulent.”

In the end, the Senate upheld the preliminary objection, agreeing that the contested impeachment Motion could not proceed to a full hearing.
