NAIROBI — A Nairobi court has ordered two teenagers accused of desecrating the Kenyan flag at Nyayo Stadium to remain in custody as investigations continue.
The boys, aged 14 and 17, were filmed stepping on the flag during a football match earlier this month. The footage spread widely on social media, sparking public anger and calls for prosecution.
On Thursday, the pair appeared before Senior Resident Magistrate Rose Gitau. They face charges of being in the country unlawfully, damaging a national symbol and causing a disturbance.
But the case did not proceed to plea taking. The magistrate directed that the teenagers be placed at the Gigiri Children’s Protection Unit while probation officers prepare a social inquiry report. “This matter involves minors, and due process must be observed before charges are addressed,” Ms Gitau said.
Relatives of the boys asked the court to release them into their custody. The request was declined after the court established that the guardians were not biological parents.
The two are expected back in court next Wednesday for further mention of the case.
Desecration of the national flag is considered a serious offence in Kenya, punishable under the National Flag, Emblems and Names Act. The incident has stirred debate online, with some Kenyans demanding harsh penalties while others call for a rehabilitative approach, noting the boys’ age.
For now, the court’s focus is on balancing accountability with child protection.
