NAIROBI — Former Baringo Central MP Sammy Mwaita has been charged in a Nairobi court with fraud, abuse of office, and forgery in connection with a Ksh150 million land dispute involving two prime properties in the capital.
Mwaita, who once served as Commissioner of Lands, is accused of orchestrating the illegal transfer of two parcels identified as Plot “A” and Plot “B.” The prosecution alleges he worked with co-accused Brian Kiptoo Kiplangat to produce fraudulent title deeds for Land Reference No. 209/9968 IR No. 85847.
The alleged fraud dates back to March 30, 2001. Prosecutors say Mwaita and Kiplangat fabricated ownership documents without the knowledge of the actual landowners, Rose Njoki King’au and Micugu Wagatharia.
“Mwaita conspired to prepare and register documents with the intent to illegally claim land that did not belong to him,” the court was told.
The charges include conspiracy to commit a felony, abuse of office, forgery, and providing false information to a public officer. According to court records, Mwaita falsely informed the Directorate of Criminal Investigations in March 2020 that the parcels belonged to S Haba Trustees Limited, a claim the prosecution says he knew was untrue.
Magistrate Ben Mark Ekhubi released Mwaita on a Ksh10 million bond or a cash bail of Ksh2 million. Former Baringo Central MP Sammy Mwaita was also ordered to provide two sureties.
The magistrate directed that Kiplangat, who did not appear in court, be summoned to face charges on Tuesday, August 5.
If found guilty, Former Baringo Central MP Sammy Mwaita could face years in prison and asset recovery proceedings, adding to growing public scrutiny over corruption and historical land injustices linked to former government officials.
