The Ethics and Anti-Corruption Commission (EACC) has recovered public land valued at Ksh50 million in Mombasa that was illegally acquired by a private company. The property, situated within the Kenya Railways Light House Kizingo Estate, has now been handed back to the Kenya Railways Corporation. The contested land, identified as parcel number Mombasa/Block XXVI/1137, covers approximately 0.0873 hectares. It lies along Pwani Road near the junction with David Kayanda Road and contains a four-bedroom house and garage originally developed in the 1950s by the East African Railways and Harbors Corporation.
According to a statement from EACC, the property had been irregularly allocated to Kizingo Apartments Limited and later transferred to Kizingo Condominium Limited in 2011. “The property has remained under the occupation and control of the Kenya Railways Corporation since its establishment,” EACC stated.
EACC filed a recovery suit on July 7, 2020, at the Environment and Land Court in Mombasa following investigations that revealed the irregular transfer.
The matter was settled through an Alternative Dispute Resolution (ADR) process. In a consent agreement recorded before Justice Stephen Kibunja, Kizingo Condominium Limited agreed to surrender the land to the Government of Kenya for formal registration under Kenya Railways Corporation.
As part of the deal, the company surrendered the original Certificate of Lease, allowing the land registry to correct records in favor of the corporation. The court also issued a permanent injunction barring Kizingo Condominium Limited from transferring, selling, or dealing with the property in any other way.
EACC welcomed the outcome and called on individuals and organizations holding illegally acquired public property to voluntarily return it. “The Commission reiterates its commitment to recovering illegally acquired public assets and urges those in possession of such property to surrender it for its rightful public use,” the statement said.
The efforts highlight EACC’s continued efforts to reclaim public assets wrongfully taken through corrupt dealings and restore them for national development purposes.
