Embakasi East Member of Parliament Babu Owino was yesterday acquitted of all charges in the shooting case of DJ Evolve.
During the court session, the prosecution, according to Senior Principal Magistrate Bernard Ochoi, failed to record the main witness’s testimony, and the ballistic evidence presented in court was insufficient to support the MP’s conviction. The magistrate further criticized the prosecution and investigative authorities for their poor work and the scanty evidence they provided to support the allegations they had made against the MP.

According to the magistrate, regarding samples and swabs that were taken at the crime scene on April 17, 2020, when the incident occurred, the prosecution side failed to submit medical results from testing done on the MP.
Even the ballistic expert admitted in his evidence that the bullet and the cartridge recovered at the scene did not match.
Principal Magistrate Bernard Ochoi said.
During the trial, the Embakasi East MP’s defense team, which was led by senior attorney James Orengo, Elijah Ongoya, Duncan Okatch, and Ndegwa Njiru, had emphasized that the prosecution lacked sufficient proof to support the criminal accusation.
Despite having ten witnesses lined up, including waiters, a manager of the security staff, and partygoers from the B Club where the incident that followed Babu Owino took place, the prosecution was still unable to get a conviction in the case.

After the verdict, Babu Owino thanked his legal team in a statement. However, he added that only DJ Evolve’s complete recovery will allow him to celebrate victory. The legislator declared plans to aid the sick DJ in seeking medical care abroad and reiterated his support for him.
The day I will be victorious is the day I’ll see DJ Evolve walk and stand by my side. Until he recovers, I want to assure the public that will walk by his side and will always be there for him. I’m planning to take him to India for further treatment and I pray he will walk again in the near future.
